Public consultation for the City Plan Major amendment - Heritage overlay provisions will be held from 16 December 2022 to 23 January 2023 (inclusive).

The following changes to the City Plan are proposed:

• Update to the Strategic Framework element - Cultural heritage to improve consistency with the Heritage overlay code
• Additions and corrections to the mapping of 9 Local heritage places and 5 Places in proximity to a Local heritage place
• New assessment provisions for development involving demolition,  partial demolition or removal
• Changed levels of assessment for some types of development
• New Exemption Certificate process for development that has no more than a minor impact on a Local heritage place
• New City Plan policy – Heritage management to guide development applications

The changes are required to provide greater clarity around the location of Local heritage places for protection and requirements to guide development applications.  The new Exemption Certificate process is intended to facilitate development which has no more than a minor impact to the significance of a local heritage place.

Anyone can propose a place to be considered for entry in the Local Heritage Register by submitting an application using the form available here: https://www.goldcoast.qld.gov.au/files/sharedassets/public/pdfs/forms-amp-applications/proposing-place-for-entry-local-heritage-register.pdf  The nomination should be submitted to heritage@goldcoast.qld.gov.au.

The application requires a sound and reasoned argument based on one or more of the following relevant criteria, and requires documentary evidence about why the place is of cultural heritage significance to the Gold Coast in support of the application.

· The place is important in demonstrating the evolution or pattern of Gold Coast’s history

· The place demonstrates rare, uncommon or endangered aspects of Gold Coast’s cultural heritage

· The place has potential to yield information that will contribute to the knowledge and understanding of Gold Coast’s history

· The place is important in demonstrating the principal characteristics of a particular class or classes of cultural places

· The place is important because of its aesthetic significance

· The place is important in demonstrating a high degree of creative or technical achievement at a particular period

· The place has a strong or special association with a particular community or cultural group for social, cultural or spiritual reasons

· The place has a special association with the life or work of a particular person, group or organisation of importance in Gold Coast’s history

The draft Heritage overlay provisions amendment incorporates the provisions of Temporary Local Planning Instrument (TLPI) No 9 (Protection of Old Burleigh Theatre Arcade) 2021 which will cease to have effect on 31 July 2023. The amendment is important to ensure these provisions are adopted in the City Plan before the 30 July 2023.

Aboriginal cultural heritage is protected under the Aboriginal Cultural Heritage Act 2004, which requires all land users to exercise a Duty of Care when undertaking activities. Reported Aboriginal cultural heritage is recorded in a database administered by the Department of Seniors, Disability Services and Aboriginal and Torres Strait Islanders.

There are a number of options for lodging a submission:

Please note that submissions that are not related to these proposed refinements are not relevant and cannot be considered.

Due to legislative requirements, formal submissions must meet the following criteria: 

• be relevant to the items listed in the update package
• be received by midnight 23 January 2023
• detail the name and address of each person making the submission
• detail the grounds of the submission and the facts and circumstances relied upon to support the grounds.

This consultation relates to specific heritages items that amend the existing City Plan. The City can only consider submissions that relate to these items.

Please note that submissions that are not related to these proposed changes are not relevant and cannot be considered.  

Each person who lodged a submission is given a unique submission number. A submission assessment summary is being prepared by the City which provides a summary of the points of submissions and the submitter’s submission number. This will enable submitters to determine how Council has addressed their items. The complete consultation report will be made available following public consultation once all significant and non-significant changes have been addressed

Public consultation will run until 23 January 2023. Once submissions are considered, and if there are no further significant changes proposed, the amendment will progress to the Department of State Development, Infrastructure, Local Government and Planning requesting Ministerial approval to adopt. Once the City receives approval from the Minister, the amendment is required to be adopted by Council before it can commence.
