Proposed Subordinate Local Law No. 7.5 (Public dive precincts) 2021

Consultation has concluded

Council of the City of Gold Coast (the City) is proposing to make Subordinate Local Law No. 7.5 (Public dive precincts) 2021 to regulate the newly constructed dive attraction ‘Wonder Reef’.

Wonder Reef was installed in early August 2021 approximately 2.5 kilometres offshore from Philip Park, The Spit. Following 6-8 months of monitoring and reporting to satisfy conditions of approval, diving is planned to open to the public in early 2022.

The City’s current Local Law No. 7 (Council Property) 2008 contains the necessary general provisions for the governance of properties under Council’s control. The establishment of a new subordinate local law is required to provide requirements and restrictions that are specific to the public dive site. The law will regulate access to the precinct and ensure there are restrictions in place to protect human safety and the natural and built environment.

The purpose and general effect of the proposed subordinate local law is as follows:

  • Allow for regulation of access to public dive precincts
  • Ensure there are restrictions in place to protect human safety and the built and natural environment, including reef infrastructure and associated fish and other marine life
  • Limit access to a public dive precinct to holders of a dive precinct permit, authorised commercial dive tour operators or those under direction of an authorised person.

The City is conducting a public interest test in relation to the anti-competitive provisions identified in the proposed subordinate local law.
