What is the consultation period?

Public consultation for the New Road Widening Overlay Amendment to City Plan will be held from Monday 19 August to Tuesday 17 September 2024 (inclusive).

    What are the proposed changes?

As our city grows there is a need to plan for expanding parts of our transport network to provide improved safety, active and public transport, and network efficiency. To support this process, the New Road Widening Overlay Amendment (the Amendment) proposes to identify land that is needed for future road widening projects undertaken by Council.

The primary purpose of the Amendment is to ensure new buildings and structures are not constructed in areas required for future road widening and that they are also set back from future roads. The Road widening overlay also seeks to ensure new development is designed and located to avoid reliance on areas required for future road widening. This is to ensure development remains functional after the road widening has occurred.

The proposed changes do not affect existing lawfully established uses or current development approvals. The Road widening overlay will only apply to new development.

    The Amendment involves:

    • the creation of a new Road widening overlay map and code in City Plan
    • additions to the Tables of assessment to establish the overlay
    • amendments to section 1.5 of City Plan to apply the overlay to building works
    • amendments to the Transport code and related sections to remove redundant content relating to earlier road widening provisions.

A submission assessment summary will be prepared by the City which provides a summary of the points of submission and the submitter’s submission number. This will enable submitters to determine how Council has addressed their items. The complete consultation report will be made available following public consultation once all significant and non-significant changes have been addressed

Will I be able to see all submissions and responses?

The City will be publishing a consultation report after the consideration of submissions. This will be made available online. No names will be published.

    What happens next?

Public consultation will run until 17 September 2024. Once submissions are considered, and if there are no further significant changes proposed, the amendment will progress to the Department of Housing, Local Government, Planning and Public Works (DHLGPPW) requesting Ministerial approval to adopt. Once the City receives approval from the Minister, the amendment is required to be adopted by Council before it can commence.
